Values and Models of Restorative Justice

Abstract

Restorative justice, as it is a diverse practice, with theoretical foundations that can vary, can assume different - and even conflicting - meanings and objectives, depending on those involved in its theorization and application and, mainly, the goals pursued. Through qualitative research, employing bibliographical investigation, and adopting the hermeneutic approach, it is investigated the objectives to be pursued by restorative justice, focused on responsibilization, are investigated. With this aim, the concept of restorative justice and restorative values are discussed (constraining values, maximising values and emerging values); and the debate turns to the minimalist and maximalist aspects of restorative justice, with an addendum to discuss the proposal for non-punitive censorship, by André Giamberardino. Finally, an analysis of alterity is carried out, understood both as a prerequisite for responsibilization and as a final objective, in a feedback process. This debate aims to generate subsidies to understand what restorative justice we want to have in Brazil and Latin America.
