JUDICIAL DECISIONS ABOUT UBER'S LABOR RELATION AND THE NEED TO REVIEW LABOR LAW TRADITIONAL INSTITUTES: HOW TO FOLLOW TECHNOLOGICAL INNOVATIONS?

This paper assumes that the debate about the legal relationship between Uber and the driver is a smokescreen in the face of the challenge of reconciling labor law with technological innovations. After pointing out this problem, we propose at the end three normative reflections to indicate the path we deem appropriate, proving the viability of labor compliance in the fulfillment and promotion of labor standards, as example. The corrosion of the typical employee figure and of the labor rights, especially with false dichotomies, is not the best way that Labor Law can deal with technological changes.
