AS DUAS FACES DA DEMOCRACIA: REFLEXÕES SOBRE CONSTITUIÇÃO E DESOBEDIÊNCIA CIVIL NO CONTEXTO DOMÉSTICO E NO SISTEMA INTERNACIONAL

The word democracy has assumed many meanings accordingly with the historical period and with the different societies which were present at the passing centuries. In the currently occidental society, the term was put together with theoretical perspectives, such as the constitutionalism and the republicanism, being essentially present on the “rule of law”. Therefore, the democracy conquered a great role during the Contemporary Age. Nevertheless, there are different ways of seeing this expression, both in domestic politics and international scenario. Thus, the purpose of this article is to analyse in what extent the word “democracy” realizes the pretensions of theories which originated it, as well as the mechanisms of content on against the established order. This analysis will be done by a revision of the main conceptions that compose the democratic theories and an overlook about the foundation of society, as the theories of Social Contract, mainly the one present on the work of John Rawls.
