UM ESTUDO SOBRE A VISÃO TRADICIONAL DA DISTINÇÃO ENTRE DIREITO NATURAL CLÁSSICO E MODERNO

Legal history opposes classic and modern natural law as the great divide in natural law. The specifics of this distinction, though potentially questionable in a history of ideas commited to discontinuities, can be explored in order to discover keys to comprehend the authors involved in the natural law debate, which here led to comparing the differential marks found by Leo Strauss to those found by Michel Villey, who produced in their own way a history of natural law ideas. It was concluded that they agree that the abandonment of the classical conception of nature as well as individualism are the marks of modern natural law. Their disagreement regarding other differential marks can be attributed to the different authors selected as representative of each tradition as well as to the distinct readings of them, whilst their concurrence can be attributed mainly to the way that both of them attempt a history of ideas with a philosophical purpose.
