ESTADO DE DIREITO E ATIVISMO JUDICIAL

This article aims to analyze the challenges faced by the Rule of Law, particularly in light of the expanding role of the Judiciary in Brazil. In this context, it examines the phenomena of the judicialization of politics and judicial activism, as well as their impacts on democracy. Drawing from a bibliographical review of national and international legal scholarship, the study seeks to understand the concept of the Rule of Law and its interface with judicial activity in the realization of constitutional rights and values. Throughout the research, it is found that the Rule of Law constitutes an essential pillar for ensuring equality before the law and for maintaining an independent and impartial legal system. However, its mere existence does not, in itself, guarantee the fulfillment of these ideals. The Rule of Law faces a range of contemporary challenges, notably the proactive role of the Judiciary and the increasing judicialization of political issues—phenomena that raise important debates concerning the democratic legitimacy of judicial decisions. The main challenge, therefore, lies in achieving a balance between the enforcement of fundamental and social rights and the preservation of institutional and democratic stability, based on foundational principles such as the separation of powers and access to justice.
