LIMITAÇÕES ADMINISTRATIVAS DE CARÁTER DESAPROPRIATÓRIO
IMPLICAÇÕES E ENTENDIMENTOS DA “DESAPROPRIAÇÃO À BRASILEIRA”

The objective of this article is to analyze the so-called "Brazilian way expropriations", expropriatory phenomena resulting from administrative limitations that are not restricted to mere conditioning of the exercise of the right or only to a delimitation of its scope, but when the regulatory claim ends up exceeding itself, disproportionately violating the essential content of the property, thus generating the so-called "Brazilian expropriation". To this end, a brief theoretical exposition will be made about the two modalities of State restrictions on private property - limitation and expropriation - in order to then address in more depth the issue involving the identification of the excesses of regulatory power in the imposition of administrative limitations and the proper treatment of the matter, passing through an analysis of the issue from the perspective of comparative law and observing how this issue has been treated by Brazilian legal bodies.
