Regarding the metaphor, A JUDICIAL PROCESS IS A WAR in court discourse: a Cognitive Linguistics perspective

This work aims to study the conceptual metaphor that A JUDICIAL PROCESS IS A WAR, using the Cognitive Linguistics theoretical and methodological framework. We consider this expression as a “metaphorical pattern”, i.e., a recurring conceptualization scheme, which can be found in court discourse. To do this, we will analyze intentionally-sampled examples taken from sentences passed by various courts in and for the Province of Buenos Aires (Argentina), followinga qualitative perspective. We aim at showing how the use of this metaphorical pattern highlights: 1) a way of understanding court proceedings as a complex battle between people having opposing interests, in which each party wishes to prevail; and 2) particular socio-pragmatic motivations that allow us to identify a form of "metaphorical thought" connected to “communicativeroutine” inherent to judicial.
