NATURAL DISADVANTAGES AND JUSTICE
a criticism of Rawls’ conception of equality based on Sen and Nussbaum’s capability approach

The primary goals of this paper are to analyze the conception of equality operative in John Rawls's theory, to identify its implications for other aspects of the theory and to assess whether such implications are admissible for a theory that intends to promote the idea of justice. Initially, the correlation between the ideas of equality and justice will be discussed. Next, after reviewing Rawls's theory to explain his conception of equality, Sen and Nussbaum's criticisms of this conception will be presented. Finally, the alternative proposed by these authors will also be presented, in opposition to the Rawlsian approach. In conclusion, the arguments presented in the previous sections will be recapitulated in order to show the pertinence of the criticisms of the Rawlsian project, demonstrating the incompleteness of Rawls's theory and highlighting that the debate on the concepts discussed in this paper remains open.
