Abstract

This article examines relationships among democracy, hegemony and
the law as a component of the superstructure, in face of an analysis of the philosophy
of the praxis. Through a study of Gramsci’s texts, the author opposes
public and private, collective and individual, in the history of the incorporation of
Roman Law and elicits reflections on the theme of the modern State coinciding
with the liberal conception of law.
