UMA ANÁLISE DAS DECISÕES MONOCRÁTICAS EM RECLAMAÇÕES CONSTITUCIONAIS ENVOLVENDO CONTRATOS DE TRANSPORTADORES AUTÔNOMOS DE CARGA (TAC)

This article aims to explore the origins of the current demand for the jurisdiction of the Brazilian Supreme Court on issues related to labor outsourcing, focusing on the repercussions arising from ADC 48, the original action that declared the constitutionality of Law No. 11.442/2007, especially in relation to the number of Claims that cite it as one of the invoked precedents. The article seeks to reflect on and rationalize the demand from the Labor Court to the Supreme Federal Court. The methodology used is based on a literature review. It can be concluded with this paper that there is a need to establish clear criteria for formalizing the competence of the Labor Court to declare an employment relationship, even in cases where the jurisdiction of the Common Court is necessary to declare fraud in the contracts of the Autonomous Cargo Transporters.
