Homeschooling models under the Theory of Regulation

Purpose – The debates about the possibility of introducing homeschooling, which dates back to the 70s in the United States of America (USA), has gained even more reverberation in Brazil. In that context, it has become particularly appropriate to provide that discussion with the results of the previous experiences taken abroad. The present article, therefore, aims to identify the most notorious characteristics of the North American regulatory model, concerning all of the fifty States; the legal limitations that a hypothetical Brazilian model would have to comply with and which would be the desirable traits for such legal framework, if seen under the perspective of the Responsive Theory of Regulation.
Methodology/approach/design – The said issue will be investigated through bibliographic and documental research with a mainly qualitative, but also quantitative, approach, and comparison between legislations to assess common attributes.
Findings – To provide a comparative study of the regulatory model of homeschooling in the USA and, as a result, there is the intent to make up a template of what should be a hypothetical regulation of homeschooling in Brazil, which must also be legally adequate, in accordance with the Responsive Theory of Regulation.
