Responsive Regulation in the National School Feeding Program – PNAE

[Purpose] This article analyzes the resolution issued by the National Fund for Educational Development (FNDE), which regulates the implementation of the National School Feeding Program (PNAE), with a focus on the provisions governing the administrative process for acquiring foodstuffs produced by family farming. The objective is to assess its impact on compliance with the legal obligation to allocate a minimum percentage of financial resources to purchasing food from family farmers. The study employs the theory of responsive regulation to propose a regulatory scaling approach aimed at enhancing the effectiveness of financial resource allocation within the program’s family farming component.
[Methodology/approach/design] The data panel prepared by the FNDE on "Acquisition from Family Farming in the PNAE" for the period between 2018 and 2022 will be analyzed, focusing on the states of the Northeast region and their capitals, in light of the key aspects of the responsive regulatory model.
[Findings] This analysis aims to identify regulatory shortcomings in the administrative resolution that may compromise the allocation of the program's financial resources for purchasing food produced by family farming. Additionally, it seeks to assess the feasibility of incorporating consensual mechanisms within the framework adopted for the application of administrative sanctions.
