The Uncertainty risk
The possible contribution of risk-based theory to the framework of COVID-19 pandemic in the public service concession contracts’ risk matrix

[Purpose] This article aims to analyze the framework of the COVID-19 pandemic in the public service concession contracts’ risk matrix, more specifically, to verify how the risk-based theory can contribute to this framework.
[Methodology/approach/design] Initially, the evolution of the risk allocation theory will be presented. Then, some concepts of the risk-based theory will be introduced, in particular, the lines of risk perception and the characteristics of risk-based regulation. Lastly, the behavior of the contractual risk matrix in the face of the COVID-19 pandemic will be analyzed. Thus, it will be verified if the risk matrix is (or can be) a regulatory tool that is able to fulfill its goal: the goal of rebalancing the contract.
[Findings] This research reveals that the pandemic is an uncertainty, not a risk, so it cannot be framed in a risk matrix. Thus, the hypothesis that other regulatory tools are necessary to guarantee the viability of the concessions is confirmed by this article.
