The Structure of High Education Regulation in Brazil: The Debate on the Creation of an Agency

Purpose ”“ To discuss the possibility of the implementation of an agency that unifies the functions of regulation, evaluation and supervision of higher education in Brazil as a measure of improvement of the structure and regulatory flows and of strengthening the public policy of expansion of offer and quality assurance.
Methodology/approach/design ”“ This paper adopts the perspective proposed by Daniel Halberstam of different skills and designs that the agencies may assume, according to the constitutional arrangement and context, in addition to a concept of substantive regulation, as a way of guaranteeing public policy expansion of offer with the corresponding quality.
Findings ”“ In the context of updating and rediscussing the regulatory framework, tackling the unification of the regulatory structure in an agency is an important lesson learned from successful experiences in other countries.
Originality/value ”“ The debate adds perspective to the improvement of the regulatory framework within the scope of the Ministry of Education.
