Analysis on the bioethical foundations of the mandatory use of contraceptive methods by women participating in research

Ethical rules related to research on human beings in Brazil is ruled by the National Health Council resolutions, the main one being the Resolution 466 of 2012, which replaced the Resolution 196 of 1996. A characteristic of CNS resolutions is a concern with protecting the participant of research. In this sense, specifically item 3.2.t, determines the non-mandatory use of contraceptives in clinical research. Analyzing this item from a principialist bioethics approach, there is a contrast between the principles of non-maleficence and respect for autonomy. From the perspective of Intervention Bioethics, this item would be justified by autonomy, equity, fairness, non-discrimination and non-stigmatization, as it eliminates restrictions for the participation of women with exclusively homoafective relations and/or not sexually active. Item 3.2.1 is, therefore, ethically justified.
