UMA ABORDAGEM REALISTA E SISTÊMICA

The present article aims to elaborate an analysis of the main doctrines regarding penal abolitionism, adopting a complex realistic meta-ethic, as well as a systemic approach to Law, inspired by the works of Niklas Luhmann. It aspires to critically investigate the foucaultian, materialistic and phenomenological strands of this criminological movement, by revealing its possible contributions to the legal system, as well as its counterproductive aspects to an autonomous and autopoietic rule of law.
