Dynamic Blocking of Sports Broadcasts

A New Frontier for Telecommunications Law and Intellectual Property

Abstract

[Purpose] The objective of this article is to analyze the reconfiguration of telecommunications law and copyright enforcement driven by the dynamic blocking of live sports broadcasts.

[Methodology] Using a qualitative documentary analysis methodology of court cases in Canada, Europe, and India, the study examines the convergence of automated monitoring technology and judicial remedies.

[Findings] The results demonstrate a global escalation towards preventive, real-time blocking measures, expanding the liability of internet intermediaries to include even virtual private network providers. It is concluded that while this new paradigm offers an effective response to piracy, its institutionalization poses serious challenges to due process and fundamental rights, such as freedom of expression. This model, forged in the protection of sports assets, sets a precedent for more controlled internet governance, where algorithmic technology assumes quasi-judicial functions, demanding continuous scrutiny to balance intellectual property protection with digital-era freedoms.
